10 Years Long Residence

The Long Residence route allows individuals who have been legally residing in the country for a continuous period of 10 years to apply for Indefinite Leave to Remain (ILR). 

If an individual has been lawfully residing in the UK for 10 or more continuous years, they may be eligible to apply for Indefinite Leave to Remain (ILR) under the 10-year-long residence route. It is crucial to emphasise that the 10-year period must constitute continuous residence. Acquiring ILR implies that the individual will be legally resident in the UK without any immigration restrictions. ILR also serves as a prerequisite for applying for British naturalisation as a British citizen.

Who is eligible to apply?

    • They must have Leave to Remain in the UK, which can be obtained in any single immigration category or a combination of categories.
    • They must have been legally resident in the UK for 10 continuous years.
    • They must have adhered to the terms of their UK visa and not violated any immigration laws or received any criminal convictions.

What is continuous residence?

Continuous residence is the period an individual has lawfully spent in the UK without any major gaps or absences. During this time, an individual is allowed to:

  • Leave the UK for up to 180 days per year or 540 days in total over a 10-year qualifying period. It’s important to note that leaving the UK on a valid visa and re-entering on a different valid visa within 180 days will not break the continuous residence. 


However, time spent in prison, young offender institutions, secure hospitals, the Republic of Ireland, Isle of Man, or Channel Islands cannot count towards an individual’s continuous residence.

When can an application be made for ILR under the 10-year-long residence route?

The earliest point at which an individual can apply for Indefinite Leave to Remain (ILR) under the 10-year-long residence route is 28 days before completing the 10-year qualifying period. Applying earlier than this will result in the application being refused, and the fee paid will not be refunded..
