Getting a Divorce

If you have been married for one year or longer, you can get a divorce by showing that your marriage has irretrievably broken down. 

Before 6 April 2022, this could be proven by basing the application upon one of five factors:

  • Adultery
  • Behaviour
  • Two years of separation plus the consent of both parties
  • Desertion
  • Five years of separation without consent. 


For divorces after 6 April 2022, the application is not based on these legal facts. Instead, one or both parties can make a simple statement that their marriage has irretrievably broken down, without giving any further details. This is often referred to as ‘no-fault divorce.’ The process of obtaining a divorce is relatively straightforward, and the introduction of no-fault divorce has reduced the need for couples to appear in front of a judge. 

Divorce solicitors can provide legal advice and guidance throughout the divorce process, including help with completing the necessary forms, negotiating with your spouse’s solicitor, and representing you in court if necessary.

Do I still need a Divorce Solicitor?

How long will the divorce process take?

A straightforward divorce, where both parties agree on all matters, can typically be finalised within 6 to 8 months. However, if there are contested issues, particularly involving finances or arrangements for children, the process can take considerably longer, sometimes over a year.

It’s also important to note that certain aspects of the process, like financial settlements and Consent Orders, may extend beyond the Final Order that legally ends the marriage.
